OFFICIAL RULES

NO PURCHASE OF ALCOHOL OR PURCHASE OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. ALCOHOL IS NOT A PRIZE. MUST BE TWENTY-ONE (21) OR OLDER TO ENTER. VOID WHERE PROHIBITED BY LAW. THIS SWEEPSTAKES IS INTENDED FOR ENTRY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. 

SPONSOR: The “Napa Above & Beyond” Sweepstakes (the “Sweepstakes”) is sponsored and administered by Rutherford Hill Winery, 200 Rutherford Hill Road, Rutherford, CA 94573 (the "Sponsor"). 

SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:00:00 a.m. Pacific Time ("PT") on October 6, 2026 and ends 11:59:59 p.m. PT on December 31, 2026 (the "Sweepstakes Period"). For purposes of these Official Rules, all times are given in PT.  The date and time stamp of the Website (defined below) will be the official time keeping device for this Sweepstakes.

ELIGIBILITY: Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are twenty-one (21) years of age or older at the time of entry (each, an “Entrant”). The Entrant who is selected as the grand prize winner (the “Grand Prize Winner”), must have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the grand prize (“Grand Prize”). Valid social security numbers will be determined by IRS requirements as further defined in the “PRIZE CLAIMS” section of these Official Rules. The following individuals are not eligible to participate in the Sweepstakes: employees, contractors, directors and officers of Sponsor and each of its respective parent, subsidiaries and affiliated companies, distributors, wholesalers, retailers, other alcoholic beverage retailers, wholesalers, distributors and suppliers, and any agencies involved in the administration, development and fulfillment of the Sweepstakes including, but not limited to, the independent administrator (the “Independent Administrator”), and any other web design, advertising, marketing, public relations, and prize fulfillment companies, and the immediate family members (spouse, domestic partner, parent, child, sibling and spouse or "step" of each) and those living in the same households of each such individual. Sweepstakes is subject to all federal, state and local laws and regulations.  Sweepstakes is void in Puerto Rico, the US Virgin Islands, US Military installations in foreign countries, all other US territories and possessions outside the fifty (50) United States and the District of Columbia and wherever else restricted or prohibited by law.

AGREEMENT TO OFFICIAL RULES: Participating in the Sweepstakes constitutes your full and unconditional agreement to these Official Rules and the decisions of the Sponsor which are final and binding in all respects.

HOW TO ENTER: To enter the Sweepstakes, Entrants must visit https://www.rutherfordhill.com/aboveandbeyondsweeps (the “Website”) or scan the unique code on the Sweepstakes promotion materials to access the Website, and complete the official entry form in its entirety, including your first name, last name, email address, state, zip code and date of birth.  Then, after signing up for the Sponsor’s email list, press the “Submit” button to earn one (1) entry into the Sweepstakes. Limit of one (1) entry per Entrant. 

Any attempt by any person to enter more than the stated number of entries by using multiple/different social media accounts, email addresses, identities, and/or any other methods, will void all of that Entrant’s entries.
All entries become property of the Sponsor and will not be returned.  Entrant understands and agrees that the Sponsor and Sweepstakes Entities are not responsible  for  any  entry  that  is  lost,  late, misdirected, inaccessible, unviewable or undeliverable, whether due to; (a) system errors, omissions, interruptions, deletions, defects, delays, theft, or  destruction; (b) failed, faulty, incomplete or garbled computer or telephone transmissions or other telecommunication malfunctions, hardware or software errors of any kind; (c) lost or unavailable network connections, typographical or system errors and failures, technical malfunctions, or otherwise. Entries that are late, lost, damaged, misdirected, stolen or not delivered are not the responsibility of Sponsor and will be disqualified. Use of any automated system, software application that enable users to create multiple accounts and/or temporary accounts to participate in the Sweepstakes or to redeem prizes is prohibited and may result in disqualification from the Sweepstakes.  Entry may be reviewed and approved by the Sponsor and may be disqualified if not submitted in accordance with these Official Rules. 

CONDITIONS OF ENTRY: Entries must be entered directly by the Entrant. Duplicate or incomplete entries will be disqualified. Entries not legitimately submitted in accordance with these Official Rules are void. Only qualified entries received by Sponsor during the Sweepstakes Period are eligible for participation. Submitting mass entries or entries generated by an automated program, script, or macro, or the use of any other similar device, program, or method to enter this Sweepstakes is prohibited and will result in disqualification. If the identity of the individual who participated in the Sweepstakes cannot be resolved to Sponsor’s satisfaction, the affected individual’s entry will be deemed ineligible. Sponsor may, in its sole discretion, disqualify any individual it finds to be in violation of these Official Rules, tampering with the entry process or the operation of the Sweepstakes (including without limitation, tampering with websites or email addresses), or acting in a non-sportsmanlike or disruptive manner. Any attempt to undermine the operation of the Sweepstakes may be a violation of criminal or civil law, and Sponsor may seek damages to the fullest extent permitted by law from any person it finds to have made such an attempt.
You agree to release the Sweepstakes Entities (as defined below) from any action or liability resulting from your participation in the Sweepstakes and/or any other information included in any entry.  Normal internet access and usage charges imposed by Entrant’s online service may apply and are Entrant’s sole responsibility. If entering via mobile device, normal phone/data and usage charges imposed by Entrant’s phone service may apply and are Entrant’s sole responsibility.
Sponsor is not responsible if a potential winner does not receive a prize because erroneous, expired, canceled, fraudulent, or fake information was provided during the Sweepstakes. Proof of sent entry or entry receipt (such as a copy of a “thank you” message) does not constitute proof of actual receipt of entry by Sponsor for purposes of this Sweepstakes.

RANDOM DRAWING: There will be one (1) random drawing held for this Sweepstakes on or about January 15, 2027. For the drawing, one (1) Grand Prize Winner will be selected at random from among all eligible entries received. Odds of winning the Grand Prize are dependent on the total number of eligible entries received during the Sweepstakes Period. The random drawing will be conducted by the independent Administrator whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects. 

NOTIFICATION: The Grand Prize Winner will be notified by the Independent Administrator by email following the random drawing and must respond to the notification with completed “Required Documents” as further described in the “PRIZE CLAIMS” section below by the date indicated (seven (7) days) to accept the Grand Prize.  If the Grand Prize Winner does not respond to the notification by the date indicated Independent Administrator will make one (1) additional attempt to reach the Grand Prize Winner by email. If the Grand Prize Winner does not respond after two (2) attempts have been made, the original Grand Prize Winner will be disqualified and an alternate Grand Prize Winner (selected randomly) and notified as outlined above. ALTERNATE NOTIFICATION (if needed): Such alternate (if applicable), must respond to the notification by the date indicated to accept the Grand Prize.  If the alternate does not respond to the notification by the date indicated Independent Administrator will make one (1) additional attempt to reach the alternate by email. If the alternate does not respond after two (2) attempts have been made, the alternate will be disqualified and an additional alternate (selected randomly as outlined above) will be notified in the same fashion. If Independent Administrator cannot verify a Grand Prize Winner after notifying up to five (5) alternates in accordance with this section, the Grand Prize will not be awarded. 

Personal Information, including entry information received, will be used to verify eligibility and award the Grand Prizes. In the event of any dispute concerning the identity of any entrant of an entry, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting account. Sponsor and its agencies are not responsible for notifications that are misdirected because of email addresses that are no longer correct, or for any other reason beyond the exclusive control of the Sponsor.

 
PRIZE CLAIMS:  Except where prohibited, the potential Grand Prize Winner will be required to complete, execute and return an Affidavit of Eligibility, Liability and Publicity Release (the “Release”) and an IRS Form W-9 and any other documents required by Sponsor, (collectively, the “Required Documents”) within seven (7) days or less from receipt of notification from the Independent Administrator by email. If the potential Grand Prize Winner fails to return the Required Documents within the time-period required, or if the email is returned as undeliverable, such potential Grand Prize Winner forfeits his/her right to the Grand Prize and an alternate will be notified as outlined in the “NOTIFICATION” section above, even if the disqualified potential Grand Prize Winner’s name may have been publicly announced.  Potential Grand Prize Winner must report income to the IRS.  In the event it is deemed during the verification process that a potential Grand Prize Winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the Grand Prize, such potential Grand Prize Winner will be disqualified, and an alternate will be notified as outlined above.  Valid social security numbers will be determined by IRS requirements. If it is determined by the Sponsor, in its sole discretion, that a potential Grand Prize Winner is not eligible or otherwise not in compliance with these Official Rules, such potential Grand Prize Winner forfeits his/her right to the Grand Prize and an alternate will be notified as outlined in the “NOTIFICATION” section above, even if the disqualified potential Grand Prize Winner’s name may have been publicly announced. In the event a potential Grand Prize Winner is disqualified for any reason, Sponsor/Independent Administrator shall have no liability or obligation to such individual. Acceptance of the Grand Prize constitutes Grand Prize Winner’s permission for Sponsor and its designees to use Grand Prize Winner’s name, photograph, likeness, voice, biographical information, statements of address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation.

PRIZE: One (1) Grand Prize will be awarded in this Sweepstakes. The maximum Approximate Retail Value (“ARV”) of the Grand Prize is $5,000 and includes a two (2) night trip to Rutherford, CA for the Grand Prize Winner and one (1) guest (the “Travel Companion”) (“Trip”). Trip will include; (a) round trip coach class air transportation through an Airline of Sponsor’s sole choosing for Grand Prize Winner and one (1) Travel Companion from a major commercial airport near Grand Prize Winner’s home (as determined by Sponsor in their sole discretion) to an arrival city closest to Rutherford, CA, (b) round trip ground transportation from the airport to the hotel in the destination city (and to/from activities while on the Trip); (c) two (2) nights hotel accommodations at a hotel to be determined at Sponsor’s sole discretion; (d) an exclusive, VIP experience at Rutherford Hill Winery (alcohol or the consumption of alcohol is not included as part of this Grand Prize); (e) a VIP Experience at Chimney Rock; (f) dinner for the Grand Prize Winner and Travel Companion for two (2) days; and (g) a hot air balloon experience.
Trip Details: Accommodations are based on one room, double occupancy and include room and tax only. Grand Prize Winner and Travel Companion must comply with the terms and conditions set forth by Sponsor’s travel coordinator(s), including, but not limited to the requirement for deposit to cover incidentals which may be required by the hotel. If Grand Prize Winner elects to partake in any or all portions of his/her Grand Prize with no Travel Companion, the Grand Prize will be awarded to Grand Prize Winner based upon the total number of travelers and any remainder of the Grand Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Trip must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption. Specific travel arrangements are subject to air travel, holiday, blackout dates, and other prize and travel restrictions. Trip must be taken by January 1, 2028 or Grand Prize will be forfeited, subject to the following blackout dates: May 28, 2027 thru May 30, 2027 and December 31, 2027. ARV of Grand Prize may vary depending upon the points of departure, destination city, ground transportation, and/or airline fare fluctuations. Any difference between the stated ARV and final ARV of Grand Prize will not be awarded. Grand Prize consists only of the elements expressly set forth herein; no other elements or expenses (including, without limitation, insurance, additional meals and snacks, unspecified ground transportation, phone calls, gratuities, incidentals, souvenirs, gasoline, other personal expenses, etc.) are included in the Grand Prize and all such expenses are the sole responsibility of the Grand Prize Winner. Grand Prize Winner is responsible for any air travel taxes and/or expenses, including applicable departure taxes or fees, baggage fees, inspection charges, and security charges. Grand Prize Winner and Travel Companion are responsible for obtaining all required travel documents, including but not limited to photo identification, passports and any other required travel documents, which shall be determined solely by the Grand Prize Winner. Once issued, tickets are nontransferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted. Travel arrangements must be made through Sponsor. Grand Prize Winner cannot assign or transfer the Grand Prize to another person.  No prize substitution or cash alternative allowed except at the sole discretion of the Sponsor, who reserves the right to substitute the Grand Prize (or any portion thereof) with a prize of comparable or greater value, in their sole discretion if Grand Prize, or any portion thereof becomes unavailable. The Sponsor will determine airline and flight itinerary subject to final Sponsor approval. No refund or compensation will be made in the event of the cancellation or delay of any flight. Reservations made are subject to availability and may be restricted during major holiday periods or blackout periods.  A personal credit card imprint or cash deposit may be required by the hotel for incidental charges and personal expenses.  In the event the personal credit card or cash deposit is required by the hotel, Grand Prize Winner will be solely responsible for supplying such personal credit card and or cash deposit and for all personal expenses / incidental charges not included as part of the Trip. 
Grand Prize must be accepted as awarded without substitution and are not, in whole or in part, assignable, transferable, or available for resale. Grand Prize has no cash surrender value, except where required by law. Sponsor has made no warranty, representation, or guarantee, express or implied, in fact or in law, with respect to the Grand Prize. This includes, without limitation, any warranty, representation, or guarantee related to any Prize’s quality or fitness for a particular purpose. Grand Prize is subject to availability and Sponsor may substitute the Grand Prize (or a component thereof) with another prize of equal or greater value if the Grand Prize is not available for any reason, as determined in Sponsor’s sole discretion. Federal, state, and local taxes and all other costs and expenses associated with acceptance and use of any prize not specified herein as being awarded are the Grand Prize Winner’s sole responsibility. Only the number of Grand Prizes set forth in these Official Rules will be awarded. In the event that any error, mistake, failure or discrepancy causes more than the stated number of Grand Prizes as set forth in these Official Rules to be promoted, noticed or claimed, Sponsor may award only the stated number of Grand Prizes by conducting a random drawing from among all legitimate, unawarded, eligible prize claims.

GENERAL RULES/VERIFICATION: By acceptance of the Grand Prize, Grand Prize Winner grants permission to the Sponsor and its agencies to use first name, last initial, city, state, photos, and likeness for purposes of advertising, promotions, and trade without further compensation, except where prohibited by law.  By entering, Entrants/Grand Prize Winner hereby agrees to release and indemnify Sponsor and affiliated companies, advertising and promotional agencies, including the Independent Administrator, and Grand Prize suppliers and their respective officers, directors, shareholders, owners, employees, agents, attorneys and representatives (collectively, the "Sweepstakes Entities") from any and all injuries, loss, claims or damages arising out of an Entrant's participation in the Sweepstakes and/or Entrant’s and Grand Prize Winner’s acceptance or use or misuse of a Grand Prize.  By participating in the Sweepstakes, Entrants agree that the Sweepstakes Entities will have no liability whatsoever for, and that Entrant will defend and hold the Sweepstakes Entities harmless against, any liability for any claims based on publicity rights, defamation, or invasion of privacy as well as injuries, damages, or losses of any kind, whether or not foreseeable, including, without limitation, direct, indirect, incidental, consequential or punitive damages to persons or to property arising out of any Grand Prize awarded hereunder. Without limiting the foregoing, everything regarding the Sweepstakes, including the Website/any websites used in connection therewith and the Grand Prizes awarded hereunder, are provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, all of which are expressly disclaimed by the Sweepstakes Entities.
If for any reason the Sweepstakes is not capable of running as planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion, to cancel, terminate, modify and/or suspend the Sweepstakes and to disqualify any individual who tampers with the entry process, violates these Official Rules, or acts in a disruptive manner.  In the event the Sweepstakes is cancelled, terminated or suspended for any reason, Sponsor, at its sole discretion, reserves the right and may choose to award the Grand Prizes from among all eligible entries received prior to cancellation. 
No responsibility is assumed by Sponsor for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries; or any problems or technical malfunctions of any telephone network or lines, typographical or other errors, computer online systems, servers or providers, computer equipment, software, failure of any email sent or electronic entry to be received on account of technical problems or traffic congestion on the internet or on any website or any combination thereof, including any injury or damage to entrant's or any other person's computer related to, or resulting from, participation in or downloading any materials from this Sweepstakes.  Sponsor is not responsible for any typographical or other error in the printing of the Sweepstakes materials, administration of the Sweepstakes, or in the announcement of the Grand Prize.  Sponsor reserves the right, at its sole discretion, to disqualify any individual it determines to be tampering with the entry, to be violating these Official Rules or to be acting in a disruptive manner. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. THE PRECEDING EXPRESSLY INCLUDES BUT IS NOT LIMITED TO ANY ATTEMPT TO TAMPER WITH OR MANIPULATE THE PUBLIC VOTING PHASE OF THE SWEEPSTAKES.

DISPUTES: To the fullest extent permitted by law, Entrant agrees that: (1) any and all disputes, claims and causes of action brought by him/her arising out of or connected with this Sweepstakes or the Grand Prize awarded (collectively, “Dispute”) will be resolved individually, without resort to any form of class action; (2) any and all Disputes will be settled in an amicable discussion between the entrant and Sponsor. If any Dispute cannot be resolved in such manner, before resorting to any other legal remedy, entrant and Sponsor will be determined solely by arbitration in San Francisco, California before one JAMS arbitrator agreed upon by the parties.  The arbitration will be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This clause will not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction; (3) any and all claims, judgments, and awards to entrant will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; (4) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

ENTRANTS PERSONAL INFORMATION & PRIVACY POLICY: In addition to the information supplied at point of entry, Grand Prize Winner will also be required to provide the following information to be eligible for the Grand Prize: full name, complete mailing address, and telephone number, including area code (“Personal Information”). All requested Personal Information must be provided in accordance with these Official Rules. 

All Personal Information collected by Sponsor will be used for administration of the Sweepstakes. In addition, Entrants may receive email correspondence from, or on behalf of Sponsor, subject to Sponsor's privacy policy located at https://www.rutherfordhill.com/policies/privacy-policy.Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines, and Entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. Please refer to Sponsor's privacy policy for important information regarding the collection, use and disclosure of personal information by Sponsor.

WINNERS LIST REQUEST: For the name of the Grand Prize Winner send a self-addressed-stamped envelope, by February 28, 2027 to: “Napa Above & Beyond” Sweepstakes”, PO Box 458, Newark, NY, 14513.
